These Terms of Service (these “Terms") of Jobsite Direct, dba JobsiteDirect, Jobsite Direct ("we," "our," or "us") are an agreement that describes your rights and responsibilities as a JobsiteDirect customer.

More specifically, these Terms govern how you may access and use: (i), its subdomains, and any other website where these Terms are posted; (ii) JobsiteDirect’s online hosted services; and (iii) JobsiteDirect’s "Software," meaning, collectively, our browser extensions, integrations, mobile applications, other downloadable apps, application programming interfaces ("APIs"), and tools and documentation ((i) through (iii) collectively, our "Service", "Career Services" or "JobsiteDirect").


If you are an individual and you access or use JobsiteDirect on behalf of a company, organisation, principal, or other entity, such as your employer (each, together with its affiliates, an "Organisation"), then: (i) these Terms of Service are an agreement between us and you and us and that Organisation; (ii) you represent and warrant that you have the authority to bind that Organisation to these Terms (and if you do not have the authority, you may not access or use JobsiteDirect); (iii) your acceptance of these Terms will bind such Organisation to these Terms; (iv) your individual right to access and use JobsiteDirect may be suspended or terminated (and ownership and administration of your JobsiteDirect Account may be transferred) if you cease to be associated with, or cease to use an email address associated with, owned by, or provisioned by, that Organisation; (v) we may disclose information regarding you and your use of the Service, including Your Content (defined below), to such Organisation, or to appropriate individuals associated with that Organisation; and (vi) the terms “you” and “your”, as used in these Terms, refer to both you and such Organisation. If you sign up for JobsiteDirect using an email address associated with, owned by, or provisioned by an Organisation, or if an Organisation pays fees due in connection with your access to or use of JobsiteDirect (or reimburses you for payment of such fees), or otherwise, then we may deem you, in our sole discretion, to be accessing and using JobsiteDirect on behalf of that Organisation. You represent and warrant that all information that you provide to us regarding any Organisation on whose behalf you use JobsiteDirect, including information identifying other users associated with such Organisation or email domains owned by such Organisation, is and at all times will be truthful, accurate, and complete, and that you will immediately notify us should any such information change or no longer be truthful, accurate, or complete.

If you subscribe to any services on our site, our User Agreement will apply to the subscriptions.

Changes to these terms
We may revise these terms of use, in whole or in part, at any time by amending this page without notice to you.
Please check this page from time to time to take notice of any changes we make, as they are binding on you from the time they are posted. Your continued use of our site after any such changes are made will be considered acceptance of the changes.

Our Service
1. Eligibility

You may use JobsiteDirect only if you can form a legally binding contract with us (and on behalf of your Organisation as applicable), and only in compliance with these Terms and all applicable local, state, national, and international laws, rules, and regulations. To use JobsiteDirect, you must be at least 16 years old, and in some circumstances even older (please check your local law for the age of digital consent). You represent and warrant that you meet the applicable age requirements and are competent to agree to these Terms, or, if you are unable to form a binding contract under applicable law, you represent and warrant that you have your parent’s or legal guardian’s permission to use JobsiteDirect, and that your parent or legal guardian is agreeing to these Terms concurrently. If you are a parent or legal guardian of an JobsiteDirect user who is unable to form a binding contract under applicable law, you are agreeing to these Terms and you are responsible for such JobsiteDirect user’s activity on JobsiteDirect. JobsiteDirect is not available to any users who were previously removed from the Service.

2. Access, Restrictions, and Acceptable Use

Subject to your compliance with these Terms, you may access and use JobsiteDirect during the Subscription Term (defined below), except as may be limited by your Organisation. Except as we otherwise agree in writing or to the extent a restriction is prohibited by law, you agree not to do, and not to assist, permit, or enable any third party or Application (defined below) to do, any of the following:
disassemble, reverse engineer, decode, or decompile any part of JobsiteDirect;
use any robot, spider, scraper, data mining tool, data gathering or extraction tool, or any other automated means, to access, collect, copy or record JobsiteDirect;
copy, rent, lease, sell, loan, transfer, assign, sublicense, resell, distribute, modify, alter, or create derivative works of any part of JobsiteDirect or any of our Intellectual Property (defined below);
use JobsiteDirect in a manner that impacts the stability of our servers, the operation or performance of JobsiteDirect or any other user’s use of JobsiteDirect, or the behavior of other applications using JobsiteDirect;
use JobsiteDirect in any manner or for any purpose (including, without limitation, by providing JobsiteDirect with access to any of Your Content) that: (i) violates or promotes the violation of any applicable law, regulation, legal requirement, contractual obligation, or right of any person, including intellectual property rights, rights of privacy, or rights of personality; (ii) is fraudulent, false, deceptive, or defamatory, including phishing; (iii) promotes hatred, violence, or harm against any individual or group; or (iv) otherwise may be harmful or objectionable (in our sole discretion) to us, our providers, our suppliers, our users, or others;
overload, flood, spam, or mail-bomb the Service; or otherwise use the Service in a manner that interferes with or creates an undue burden on the Service, including by using the Service to send unsolicited communications, promotions, advertisements, or spam;
use or display JobsiteDirect in competition with us, to develop competing products or services, for benchmarking or competitive analysis of JobsiteDirect, or otherwise to our detriment or disadvantage;
attempt to interfere with, compromise the system integrity or security of, or decipher any transmissions to or from the servers running JobsiteDirect;
transmit viruses, worms, or other software agents through JobsiteDirect;
impersonate another person or misrepresent your affiliation with a person or entity, hide or attempt to hide your identity, or otherwise use JobsiteDirect for any invasive or fraudulent purpose, including phishing;
use or attempt to use a log-in credential other than your own, share passwords or authentication credentials for JobsiteDirect, or otherwise circumvent the measures we may use to prevent or restrict access to JobsiteDirect or enforce limitations on use of JobsiteDirect; or
identify or refer to us or JobsiteDirect in a manner that could reasonably imply an endorsement, relationship, or affiliation with or sponsorship between you or a third party and us, other than your permitted use of JobsiteDirect under these Terms, without our express written consent.

3. Accessing our site

Our site is made available free of charge. You can choose whether to take advantage of one of the premium programs we offer to individuals and businesses, by payment of subscription fees as described in and subject to the terms of the User Agreement.
To use certain services on our site, you must register for an account. By registering for an account, you must complete a user profile and add at least one social media account (Facebook, Twitter, LinkedIn, Instagram, Pinterest or YouTube) which belongs to you. Only completed and activated profiles will be visible to recruiters. Certain information in your profile may be visible to other JobsiteDirect users who you follow, subject to the privacy choices you make within your account settings. You may edit certain information in your profile via your account and may choose to limit who is able to view certain content you post to your profile. Even if your profile is private, other users can still view your basic profile details (including your picture, number of views and followers, whether you have a premium subscription, citizenship, current location, language proficiency and reputational reference rating).
Full profile details will only be revealed to other users when those users follow you back. You agree to provide true, accurate and complete information on your profile and all registration and other forms you access on our site or provide to us, and agree to update your information to maintain its truthfulness, accuracy and completeness (including but not limited to details concerning any financial funding arrangements available to participating students in relation to opportunities posted). You agree not to provide and to correct any information about your location, your business, your skills, or the services your business provides that is or becomes false or misleading. We reserve the right to deactivate the account of any user in breach of this provision and prohibit their future use of our site.
We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. Access to our site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our site without notice. We will not be liable to you if for any reason our site is unavailable at any time or for any period.
You are responsible for making all arrangements necessary for you to have access to our site. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

4. JobsiteDirect Accounts

Your account on JobsiteDirect (your "JobsiteDirect Account") gives you access to the services and functionality that we may establish and maintain from time to time. We may maintain different types of JobsiteDirect Accounts for different types of users. You acknowledge and agree that you do not own your JobsiteDirect Account.

You may not use another user’s JobsiteDirect Account without such user’s permission. You are solely responsible for the activity that occurs on your JobsiteDirect Account, and you must keep your JobsiteDirect Account password(s) strong and secure. You should notify us immediately of any breach of security or unauthorised use of your JobsiteDirect Account. Any individual with administrator-level access to your JobsiteDirect Account can modify your JobsiteDirect Account settings, access and billing information. We will not be liable for any losses caused by any unauthorised use of your JobsiteDirect Account, or for any changes to your JobsiteDirect Account, including your ability to access your JobsiteDirect Account or Your Content (defined below), made by any individual with administrator-level access to your JobsiteDirect Account.

You may control certain aspects of your JobsiteDirect Account profile and how you interact with JobsiteDirect by changing the settings in your settings page. If you provide us with your email address, we may use the email address to send you Service-related notices, including any notices required by law, in lieu of communication by postal mail. We may also use your email address to send you other marketing or advertising messages, such as changes to features of JobsiteDirect and special offers. If you do not want to receive such email messages, you may opt out or change your preferences by logging into our preference center with the email address associated with your JobsiteDirect Account, or by clicking the unsubscribe link within each marketing or advertising message. Opting out will not prevent you from receiving Service-related notices.

5. Your account and password

If you choose, or you are provided with, a user identification ID, code, password or any other piece of information as part of our security procedures, you must treat such information as confidential and you must not disclose it to any third party or allow any other person to use or share your account. You authorise Jobsite Direct LLC to assume that any person using our site with your password either is you or is authorised to act for you.

We have the right to disable any user identification code or password at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

If you know or suspect that anyone other than you know your login information or password, you must promptly change your password via the ‘Reset Password’ facility on our site. You further agree not to use the login credentials of any other user of the site, and not to allow others to use your login credentials at any time.

6. Intellectual property rights

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it, including, without limitation, images, graphics, text, illustrations, logos, trademarks, service marks, photographs, videos and audio content. Those works are protected by copyright laws and treaties around the world. All such rights are reserved and nothing in these terms shall be deemed to create a licence of any such rights. Any copying, redistribution, reproduction, transmission, republication or modification of part or all of the contents of our site in any form is strictly prohibited except to the extent that this section permits it.
You may print off one copy, and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organisation to content posted on our site.
You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged.
You must not use any part of the content on our site for commercial purposes without obtaining a licence to do so from us or our licensors.
If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

7. No reliance on information

We may update our site from time to time, and may change the content at any time. Although we make reasonable efforts to update the information on our site and provide full details about available opportunities, please note that any of the content on our site may be out of date at any given time, and we are under no obligation to update it.
The content on our site is provided “as is” for general information only. We make no representations, warranties or guarantees, whether express or implied, about the quality, safety, truth or accuracy, or legality of, any of the information or opportunities posted; the qualifications, background, reliability or identities of the users; the ability of any providers to deliver the services or opportunities posted; the accuracy of details about financial funding arrangements available to students for any opportunities posted; or that our site, or any content on it, will meet your requirements or be accurate, reliable, complete or up-to-date.
Jobsite Direct LLC does not itself make any educational opportunities or programmes available, offer any financial support, scholarships or other opportunities advertised on our site, nor directly introduce or help to match recruiters with suitable candidates. We are not a party to the dealings between recruiters and students or graduates, and take no responsibility for posts, proposals, screening, selection, participation or application fees or costs, visa requirements, the performance of opportunities, work arrangements, or any other aspect of any relationship initiated as a result of using our site. We merely make the site available to facilitate contact between recruiters and talent, and enable users to identify and determine the suitability of opportunities and candidates for themselves.
Where you wish to request a reference from a third party, you agree to obtain permission from such referee to be contacted by Jobsite Direct LLC for this purpose before providing us with their contact details. We take no responsibility for any reference they provide. You acknowledge that any such reference may be negative or defamatory, visible on your profile to other users who follow you on the site, and may affect your reputational rating (which is visible to all users on the site).
Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only and do not imply any endorsement of those sites and resources by us. We have no control over the content, accuracy, or services provided by those sites or resources. They are not intended to amount to advice on which you should rely and you assume all responsibility and risk arising from your use of or reliance on such sites and resources.
Before taking any action on the basis of the content on our site, you must contact the relevant opportunity provider directly for official and up-to-date information and instructions about opportunities featured on our site (which are subject to change at any time), or to apply for or make queries about such opportunities. We do not have any control over the reliability of the information provided by any third parties and any reliance you place on such information is strictly at your own risk.
Translations of opportunity descriptions into other languages are machine-generated (Google Translate API) and they should not be considered complete, accurate or faithful translations. We disclaim all liability for any and all mistranslations.

8. Limitation of our liability

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied. We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable or we have been informed of the possibility of such loss or damage, arising under or in connection with:

  • use of, or inability to use, our site;
  • any negative or defamatory comments made about you by your referee(s) or other users;
  • use of or reliance on any content displayed on our site; or
  • service interruption, computer damage or system failure.
If you are a business user, please note that in particular, we will not be liable for:
  • loss of profits, data, sales, business, or revenue;
  • loss of anticipated savings;
  • loss of business opportunity, goodwill or reputation; or
  • any indirect or consequential loss or damage.

If you are a consumer user, please note that we only provide our site for domestic and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
Whilst we use our best endeavours to take all necessary steps to ensure the security of our site (including having in place an SSL Certificate), we will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any content on it, or on any website linked to it.
We assume no responsibility for the content of websites linked to on our site. Such links should not be interpreted as an endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

9. Job Ads or Job Listings

JobsiteDirect may make available Job Ads advertising employment opportunities and other job-related content, including links to third-party websites (“Job Listings” or “Job Ads”), through JobsiteDirect’s search results or otherwise through the Site. Searching for Job Ads on JobsiteDirect is free for Job Seekers. JobsiteDirect displays Job Ads based on a combination of compensation paid by employers to JobsiteDirect and relevance, such as search terms, and other information provided and activities conducted on JobsiteDirect. While JobsiteDirect may in some circumstances be compensated by employers who post Job Ads, helping keep JobsiteDirect job search free for Job Seekers, all Job Ads are considered advertising.

Job Ads are created and provided by third parties over whom JobsiteDirect exercises no control; you acknowledge and understand that JobsiteDirect has no control over the content of Job Ads, links to or from Job Ads, or any conditions third parties might impose once a Job Seeker has submitted an application or left the Site. For example, some of these third parties may attempt to charge Job Seekers a fee to apply to a particular job, although JobsiteDirect endeavors not to make such Job Ads available on the Site. If you leave the JobsiteDirect Site and choose to enter a third-party website, you accept any terms and conditions imposed by that third-party. Except for sponsored, featured, private or paid placements, the Job Ads contained on, or linked from, the Site are indexed or posted in an automated manner. JobsiteDirect has no obligation to screen any Job Ads, or to include any Job Ads, in its search results or other listings, and may exclude or remove any Job Ads from the Site or your search result without any obligation to provide reasoning for removal or exclusion. You understand and agree that JobsiteDirect has no obligation to present you with any or all Job Ads. We cannot confirm the accuracy or completeness of any Job Ad or other information submitted by any Employer or other user, including the identity of such Employer or other user. JobsiteDirect assumes no responsibility, and disclaims all liability for the content, accuracy, completeness, legality, reliability, or availability of any Job Ads, or other information submitted by any Employer or other user.

When you initiate a job application on a website operated by an Employer or its applicant tracking system, JobsiteDirect may collect certain information about you and any actions taken by you during your visit using automated means, such as via Application Programming Interfaces (API), cookies and web beacons. The information collected includes, for example, information about job listings you viewed and job applications you started and completed. An Employer who uses tracker functionality is required under this Agreement to provide any notice, and obtain any prior consent, that may be required by applicable law. However, you acknowledge and agree that JobsiteDirect has no control over such an Employer or its website. You agree to JobsiteDirect’s use of, and receipt of information from, any such tracker functionality.

JobsiteDirect may provide independent functionality to assist you. For example, JobsiteDirect may provide search options to help you narrow down Job Ads search results by job type categories (i.e. full-time, part-time, etc.), and such categories are created independently and entirely by JobsiteDirect, and may not directly or accurately reflect the content of the Job Ads. JobsiteDirect may reformat Job Listings so that you may read them more clearly on a mobile phone. JobsiteDirect may also promote Job Ads by select Employers on certain pages or websites dedicated to a specific topic, such as inclusive hiring, military-friendly job posts, or the gig economy (such as JobsiteDirect Gigs). The placement of a Job Ad on a dedicated page or website is not a representation regarding the nature of the role for legal purposes (for example gig economy postings are not necessarily limited to contractor status jobs and may also include engagements for employment relationships) or a representation regarding the attributes of an Employer. JobsiteDirect does not guarantee that applying to jobs through a dedicated page or website will lead to a better job application experience, a job interview, or a job offer. The dedicated pages or website do not contain an exhaustive list of Job Ads, and no inferences can be drawn with respect to Job Ads or Employers that are not displayed on dedicated pages. JobsiteDirect may also provide functionality to call a telephone number contained in a Job Ad using the phone app on a mobile device. JobsiteDirect cannot guarantee that the extracted phone number is the correct phone number for the Employer or for the Job Ad you are viewing.

10. Resume, CV and Profile

By creating a searchable resume through the Site (“JobsiteDirect Resume”) or uploading a file resume on the Site (collectively, “Your Resume” or “Job Seeker Resume”), you are requesting and authorising JobsiteDirect to make available Your Resume to anyone accessing our Site, such as Employers that JobsiteDirect believes may have an interest in Your Resume, users of JobsiteDirect’s Resume Search Program, or anyone with access to the URL associated with your searchable resume. You are responsible for keeping Your Resume accurate and up-to-date.

When you provide Your Resume on JobsiteDirect, Your Resume is set to searchable on JobsiteDirect (“Searchable”) by default. If you do not want JobsiteDirect to make available Your Resume to third parties or if you do not want Employers to contact you, set your JobsiteDirect Resume and uploaded file resume to not searchable on JobsiteDirect (“Not Searchable”). Resumes that are not searchable on JobsiteDirect are only made available to those to whom the Job Seeker has submitted an application or provided their resume. Applying to jobs or otherwise sharing Your Resume with Employers may result in Your Resume being copied and published even if it is set to Not Searchable. While you may change Your Resume privacy settings at any time, setting Your Resume to Not Searchable will not affect your previous applications or prevent employers you responded to from contacting you. Resumes set to Searchable, including yours, can be copied by search engines and other third parties accessing the Site, who can then make those Resumes publicly available elsewhere. JobsiteDirect does not control such third parties. If Your Resume is copied in this manner, then setting it to Not Searchable on JobsiteDirect will not affect those third parties or the copies they have made of Your Resume. Changes to Your Resume on the Site may or may not be reflected on copies made by third parties. If You do not want Your Resume to ever be publicly visible or copyable, please contact us via email to set Your Resume Not Searchable. JobsiteDirect assumes no responsibility and disclaims all liability for Your Resume or application information that you share with Employers or otherwise make public.

By creating or uploading Your Resume, you are requesting and authorising JobsiteDirect, or an JobsiteDirect vendor, to review or scan Your Resume and provide you feedback (in JobsiteDirect’s discretion), including suggested changes. We may also provide you with feedback through additional resume review services, such as helping you understand how your resume may be parsed by applicant tracking system software, feedback on ways to build a more effective resume, or a personalised resume review video. We provide this feedback directly to you, and may give you the ability to access it within your account. It is not made available to Employers. You agree that your use of any feedback or other information provided through resume review services is at your sole discretion. JobsiteDirect assumes no responsibility and disclaims all liability for any actions you take based on any provided feedback.

By creating an JobsiteDirect Resume or uploading a file resume on JobsiteDirect, JobsiteDirect may share with you Job Ads that match the contents of Your Resume. JobsiteDirect may also highlight to you items in Your Resume that may match qualifications from the Job Ad, or highlight to you items that appear in the Job Ad and may be missing from Your Resume. These highlights do not mean you are or are not qualified for the job or that you should or should not apply for it. Applying for such Job Ads does not guarantee job interviews or hiring. Even where JobsiteDirect highlights items or a Job Ad is shared with you, JobsiteDirect assumes no responsibility, and disclaims all liability for the content, accuracy, completeness, legality, reliability, or availability of Job Ads or highlights. By uploading a file resume on the Site, you agree that JobsiteDirect may convert your file resume to a different file type. It is your responsibility to review Your Resume to ensure that the content appears as you intend, and that it contains the right information or any information you intend to include or update. If you see any inaccuracy in any such material, it is your responsibility to correct such information or to contact JobsiteDirect to do so. It may take a few days for updates to your account or Your Resume to be reflected. JobsiteDirect assumes no responsibility and disclaims all liability for Your Resume or other application information you post, send or receive through the Site.

To mitigate fraud, JobsiteDirect may mask or hide your contact information, for example, we may mask or hide your email address and/or phone number, from Your JobsiteDirect Profile, Your Resume, or application, and may substitute it with an alias. JobsiteDirect makes no promise to you about whether all or part of your contact info will be masked or hidden, and the decision to mask or hide such info is in JobsiteDirect’s sole discretion. JobsiteDirect may also mask some or all of the Employer’s contact information, or an Employer may choose to mask their contact information when they contact you. In either case, you agree to an Employer contacting you from a masked phone number or email, and that you may not be able to return their call unless they provide their real number to you. JobsiteDirect reserves the right to limit your ability to set Your Resume to Searchable, and may toggle a public resume to Not Searchable, at any time, to prevent illegal conduct, for fraud mitigation, or for any other reason in JobsiteDirect’s discretion. JobsiteDirect makes no guarantee that Your Resume will be shown to any particular Employer or that any portion of the JobsiteDirect Resume database will be available to an Employer at any particular time.

11. Applying to Jobs Through JobsiteDirect

Any resume or application information that you submit through the Site, including Personal Data included in a resume, application or responses to screener questions and assessments (“JobsiteDirect Apply”), is subject to this Agreement (including Section D.3.) and to JobsiteDirect’s Privacy Policy (all references on the Site to “Apply Now”, “Easily Apply”, “Simple Apply”, “Apply from your phone”, “Apply with JobsiteDirect”, “RSVP to hiring event” or any similar references mean “JobsiteDirect Apply.”). To maintain the quality of the Site and Services, JobsiteDirect in its sole discretion may impose limits on your ability to apply to Job Listings or to other JobsiteDirect services.

You acknowledge that prior to submitting an application through JobsiteDirect Apply, you are responsible for reviewing and confirming that you are applying to your desired Employer. Once you provide information to an Employer (whether in the form of a job application, resume, email, interview material or otherwise), JobsiteDirect does not have control over the Employer’s use or disclosure of that information. If you want to request the Employer delete, modify, or maintain confidence over any such information, you must make such a request directly to the Employer. Unsubscribing from calls from Employers through JobsiteDirect does not apply to interviews you have already scheduled. If you require alternative methods for applying, you must approach the Employer directly to request such alternative method, as JobsiteDirect is not responsible for the Employer application process.

When you ask JobsiteDirect to submit your application or other information through JobsiteDirect Apply, you are sending Your Resume and application information to JobsiteDirect, and you are requesting and authorising JobsiteDirect to make available such application information to the applicable Employer(s) for the indicated Job Listing(s). You further agree to JobsiteDirect’s performance of automated processing in relation to your application, as such processing is an essential part of this Agreement. When you ask JobsiteDirect to transmit an application or a message, including, but not limited to, a signed offer letter, to an Employer via JobsiteDirect Apply or JobsiteDirect’s relay system, or store such application, you understand that this is without warranty, and that JobsiteDirect reserves the right to reformat such application or message. Additionally, you consent to your application and any responses sent to you by the Employer (including offer letters) through JobsiteDirect being processed and analysed by JobsiteDirect according to this Agreement and JobsiteDirect’s Privacy Policy.

Please note that Job Ads may expire between the time you submit your application and from the time it is received. JobsiteDirect has no responsibility for expired Job Ads or for delivering applications prior to a Job Ad’s expiration, and JobsiteDirect and its third party providers may store your application and related information regardless of whether a Job Listing has been closed or is no longer available on the Site. We also cannot vouch for the technical capabilities of any third party sites, including but not limited to ATSs. By using the JobsiteDirect Apply system, you fully consent to the above.

By using JobsiteDirect, you agree that JobsiteDirect is not responsible for the content of the Employer’s job application, messages, screener questions, skills assessments or their format or method of delivery, and that JobsiteDirect does not guarantee receipt of your application by the Employer, or your receipt of messages from the Employer. Please note that JobsiteDirect does not choose the questions asked by Employers or decide the job qualification criteria of Employers. Employers are solely responsible for compliance with all applicable laws. JobsiteDirect recommends Job Seekers follow personal health and safety best practices as recommended by the World Health Organization or similar institution. JobsiteDirect does not guarantee the validity of a job offer and cautions Job Seekers to verify the validity of a job offer before taking an adverse action regarding their current employment situations. Job Seekers are solely responsible for verifying the accuracy of any Employer or job offer.

When you search for jobs on the JobsiteDirect Job Search app and proceed to apply for a job, including jobs on third party sites, JobsiteDirect may suggest information from your JobsiteDirect profile to include in your application. It is your responsibility to review suggestions before accepting them and including them on your application.

You acknowledge that as part of its efforts to combat fraud and spam, JobsiteDirect may require that users verify their email address. When you apply to a job through JobsiteDirect, you agree that you may be required to verify your email address, and that failure to verify may lead to your application being rejected.

12. Career Services (Performance and Add-on Products)

JobsiteDirect may offer you resume review, resume scan, offer coaching, live video consulting sessions, writing services, general career guidance, or other consultation services (collectively, “Career Services”). By using Career Services, you request and consent that JobsiteDirect, or an JobsiteDirect vendor, provide you with the service you select. You may only use Career Services for advice concerning your own resume, offer, or employment situation and not another person’s. As a user of the Site, JobsiteDirect may also, from time to time, provide you career or hiring guides via blog posts, email, or other channels as part of its services to you. For example, JobsiteDirect may provide tips on improving your resume or how to use your resume effectively in the job application process, commonly asked interview questions, next steps after you have submitted an application, and how to prepare for a new job after you have been hired. JobsiteDirect offers these Career Services as optional guidelines for its users and all liability with respect to actions taken or not taken based on the contents of such Career Services are hereby expressly disclaimed.

When filling out forms associated with Career Services, you agree to provide complete and accurate information. Any information you upload through the forms, including a resume, constitutes User Content and shall be treated in accordance with any User Content sections herein. Any career-related or hiring-related information, feedback, guides or other content provided by JobsiteDirect, or JobsiteDirect’s vendor, through Career Services or otherwise, is for informational purposes only, and is in no way to be construed as professional career counseling or staffing services. You understand that JobsiteDirect may give suggestions or information regarding best-practices, however, you understand that it is ultimately your responsibility to determine how to pursue your job search or candidate search. You further understand that in providing any such career or hiring guides, JobsiteDirect is not acting as a job placement agency or staffing firm. You are responsible for reviewing any career or hiring-related information provided to you, for example, for accuracy and completeness. You are also responsible for editing the information before you use it, for example, for an employment application. JobsiteDirect is not responsible for the accuracy or completeness of any information that JobsiteDirect or its vendor provides you. You understand that by using Career Services or referring to or using any career or hiring information, you are not guaranteed job interviews, job placement, assurance of being hired, or a higher salary or increased benefit, and you take full responsibility for use of these services or information.

JobsiteDirect may offer, as part of Career Services, the opportunity for you to engage with third parties, sometimes referred to as career coaches or professional writers, to discuss job search, resume writing, or career strategies, either through the Site or in person. Regardless of how you interact with them, you acknowledge that these third parties are not employees of JobsiteDirect and that JobsiteDirect is not responsible for the content of any such discussion or any actions taken or not taken based on the contents of such discussion. Do not share any information you consider confidential or personally sensitive with these third parties. JobsiteDirect does not guarantee the quality or effectiveness of any advice, recommendations, or guidance you may receive from these third parties. You agree that, to the maximum extent permitted by law, JobsiteDirect will have no liability arising from any discussion you have with such a third party.

13. Career Services - Subscription Payment, Cancellation, and Termination.

To the extent that you use a paid Career Services offering, you shall be charged as indicated on the Site. Subject to the limited cancellation rights described below, refunds (if any) are at the absolute discretion of JobsiteDirect and only in the form JobsiteDirect finds appropriate in its sole discretion. You acknowledge and agree that any credit card, bank account, and related billing and payment information that you provide to JobsiteDirect may be shared by JobsiteDirect with companies who work on JobsiteDirect’s behalf, such as payment processors.

Online payment services will be carried out by Stripe and Paypal. Online card payment shall be subject to Stripe’s terms and conditions and online payments via Paypal shall be subject to Paypal’s terms and conditions. Payment by direct debit must be arranged with JobsiteDirect’s sales team who will provide the Client with a direct debit mandate form to complete.

The Client may provide JobsiteDirect with a recurring payment authority to enable JobsiteDirect to take regular payments from the Client’s nominated debit or credit card for payment of the Services. Such authority must be provided to JobsiteDirect’s sale team by phone or online through the Client’s account. When a recurring payment authority has been provided, JobsiteDirect will be entitled to take regular payments for the Services from the nominated debit or credit card without the need to obtain individual authorisation for every payment.

All purchases are non-refundable. The client can cancel their subscription at any time by contacting us using the contact information provided below. The Client will remain liable for any outstanding fees (if any) in the event that a recurring payment authority is cancelled prior to paying for all Services provided.

Unless a refund matrix has been set out in the Order Confirmation, once a contract has been formed, JobsiteDirect cannot accept any cancellation of the agreed Services: no refunds will be given and outstanding invoices shall remain payable. Subscription Services are for a minimum term of 12 months unless otherwise agreed with JobsiteDirect. In the event of early termination, no refunds will be given, outstanding invoices shall remain payable, and the fees in respect of any outstanding minimum term shall become payable. For Services purchased online, refunds may occasionally be given at JobsiteDirect’s sole and absolute discretion.
JobsiteDirect may, in its sole and absolute discretion, add to, modify or discontinue any of the Services from time to time. However, this will not affect any Order Confirmation agreed prior to any change or withdrawal of the relevant Service.
JobsiteDirect reserves the right to change the fees and/or these Terms from time to time, provided that no change shall be retrospective.
Without prejudice to any other remedy, JobsiteDirect may terminate the Client’s account and any or all contracts and Services with immediate effect in the event of material or persistent breach of these Terms by the Client or if JobsiteDirect has reasonable grounds to believe that the Client cannot or will not pay its debts.

When you upload or post content to our site, you grant a perpetual, worldwide, non-exclusive, royalty-free, transferable licence to Jobsite Direct LLC to use, reproduce, distribute, prepare derivative works of, display, promote, and perform that user generated content in connection with the service provided by us and across different media.
JobsiteDirect owns all rights in Career Services and other career and hiring-related material that JobsiteDirect provides you, such as video feedback and hiring tips. By using Career Services, JobsiteDirect grants you an express, non-exclusive, non-assignable, and non-sublicensable right and license to use materials developed by JobsiteDirect or JobsiteDirect vendors for you. This license is limited to personal and non-commercial use and any further use is prohibited.

15. Viruses

We do not guarantee that our site will be secure or free from bugs or viruses.
You are responsible for configuring your information technology, computer programmes and platform in order to access our site. You should use your own virus protection software.
You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored, any server, computer or database connected to our site, or any private user data associated with our site.
